Letter No. DyChE/BP/2103/ES dt. 13/05/2016 from BMC addressed to
Mr. Ranjit Singh Saini regarding Occupation Certificate for Tower A and B.
Ref. : Your letter dt. 22-03-2015 addressed to my wife, Mrs. Gurmeet Kaur Saini.
Dear Sir,
In reference to your above referred letter you had mentioned that she had made false and baseless
allegations without support of any evidence which constituted defamation of members of the Managing
Committee I wish to state as under -
The allegations are not false and baseless and they just do not need any evidence as elucidated
herebelow -
The services of the PMC which was appointed by the General Body was discontinued by the Managing Committee without the consent of the General body, perhaps all to the advantage for the Managing Committee and the Builder. From the time-to time reports of the PMC pin-pointing on the deficiences in the progress of the redevelopment, and subsequent discontinuance of their services, it is evident that both the Managing Committee and the Builder found the PMC to be a hinderance in their so-called “co-ordinated working” and hence got them removed from scene without the consent of the General Body. This is the only apt conclusion which one can draw for the removal of the PMC.
Does this act of
the Managing Committee need any evidence?
The redevelopment project started in the year 2008 and both the two towers were completed
2011. It is now almost 5 years down the lane and there is still no sight of the Occupation
Certificate in respect of the completed buildings. When the Managing Committee had removed the
PMC then was it not the duty of the Managing Committee to follow up on the redevelopment progress from the point when the services of the PMC was terminated. Did the Managing Committee see the “wrong-doings” of M/s. HCPL comstruction progress whereby the builder constructed an additional 10 ft.of construction work over and above the sanctioned plan. Was it not the duty of the Managing Committee to intimate the builder about the wrong-doing and to take appropriate action against them? Does this act of the Managing Committee also require any evidence? What was the
Managing Committee doing since the last 5 years from the year 2011 till 29-04-2016 (date of
application for OC to Executive Engineer, Building Dept.as per their letter
No. DyChE/BP/2103/ES dt. 13/05/2016 addressed to Mr. Ranjit Singh Saini). A copy of the said
BMC’s reply in this respect is attached herewith for ready reference.
This shows that during the five years tenure of the Managing Committee, I and many other members of the society are of the opinion that during this period the Managing Committee, instead of looking into the redevelopment progress, in the greater interest of the members at large, confined their main objectives into looking after their own personal interest and that of the builder which is quite evident as the Managing Committee has as of date not achieved anything material as the entire project is at a standstill since the last5 years without any progress whatsoever.
You have also mentioned in your said letter dt. 22-03-2015 that “the Managing Committee reserves
its rights to initiate both Civil and Criminal proceedings against Mr. Gurmeet Kaur Saini for
defaming the honorary Managing Committee members of the Society”. In fact wouldn’t it be
correct if the members of our society initiate both Civil and Criminal proceedings against the
Managing Committee members, viz. Mr. B.C. Thadani, Mr. M.H. Nayak, Mr. Suresh Arora,
Mr. Kishore Vengsarkar, M. Vinod Thadani, Mrs. Jaya Damodaran and Mr. Sanjay Lodha, who
are part and parcel of having signed the Managing Committee’s letter dt. 23-03-2015 for -
1) Misleading the members of the society time and again by presenting incorrect facts of
the redevelopment progress underway.
2) Removal of the PMC without the concurrence of the General Body, like I had said
earlier, perhaps for their own, and personal interests of the builder.
3) Not looking into the irregularities commited by the builder (in the absence of the PMC)
which is now causing a hinderance in our getting the Occupation Certificate (now applied
on 29-04-2016 ... after a period of 5 years).
4) Not terminating the redevelopment agreement as the builder failed to get the OC within
a period of three months from the date of the General Body as per the resolution passed
thereat.
IT HAS ALSO COME TO MY KNOWLEDGE THAT SINCE THE LAST 4 YEARS THE
BUILDER / ARCHITECT / MANAGING COMMITTEE DID NOT EVEN APPLY TO THE
BMC FOR OCCUPATION CERTIFICATE, WITH ALL COMPLIANCES IN PLACE. HOW
THEN DOES ONE EXPECT THE OC FROM THE BMC IN ABSENCE OF ANY
APPLICATION FOR THE SAME. THE MANAGING COMMITTEE HAS ALL THE TIME
BEEN MAKING LAME EXCUSES VIZ. THAT TWO OF THE MC MEMBERS ALONG WITH
TWO OTHER MEMBERS ARE CAUSING HINDERANCE IN OBTAINING THE OC. THE
MANAGING COMMITTEE HAS ALL THE TIME KEPT THE MEMBERS IN DARK. THE
EFFICIENCY OF THE MANAGING COMMITTEE IS JUST ZERO. AT THIS JUNCTURE
IT WOULD BE APT FOR THE MC MEMBERS TO HANG THEIR HEADS IN SHAME
AND TO SUBMIT THEIR RESIGNATIONS FORTHWITH.
In fact I would like to enlighten on the fact that my wife, Mrs. Gurmeet Kaur Saini had replied to your said letter dt. 22-03-2015 along with copies of evidences for all the violations of the
redevelopment agreement point to point, to which the Managing Committee did not revert back.
Inspite of such fallacies commited by the Managing Committee, the members were allegated for causing hinderances in the redevelopment work and in the last 10 years the situation has gone from bad to worse in relation to the redevelopment process. It would therefore be wise if all the members of the Managing Committee as referred to hereinabove pen down their resignation with immediate effect and oblige the members of our society, because even as of date I have doubts whether we will get the Occupation Certificate with all the required compliances?
