Dear Sir,
This letter of mine has specfic reference to your above referred letter dt. 22-03-2015 which was replied to point to point vide my letter dt. 06-05-2015 which was substantiated by documentary evidences disapproving your explanations, contentions and allegations in your said letter of my wife trying to defame the Managing Committee members. You have failed to reply to her said letter which goes to prove that the documentary evidences furnished (Attachments 1 to 10) by her only confirmed the contentions of the letter dt. 17-03-2015 to be true. I am still awaiting your reply to my
said letter dt. 06-05-2015 and am looking forwards to the denial of your managing committees wrong-doings. Your silence on the said letter would only amount to you and your managing committee accepting your defaults on the redevelopment project by having cheated the society
members for their own personal gains.
You may be informed that my wife, the only woman with no backing of any member had singularly
stood for the society members against the irregularities and agreement violation in our redevelopment project. And she was from time to time informing the managing committee and
the members at large about the irregularities being committed in our redevelopment project.
Your letter dt. 22-03-2015 carries only 7 signatures of the Mananging Committee members
instead of 9 members, viz. Mr. B.C. Thadani, Mr. M.H. Nayak, Mr. Suresh Arora, Mr. Kishore Vengsarkar, Mr. Vinod Thadani, Mrs. Jaya Damodaran and Mr. Sanjay Lodha. Kindly enlighten me as to why the other two members viz. Mr. Anil Kapur and Mr. Laxman Gurbaxani who seem to
be isolated from your golden group not sign your said letter along with the other MC members? Was it because they were not invited to this so called meeting or is it that they refused to sign the letter which contained invalid and irrelevant explanations to shelter the wrong-doings of the consortium of the Managing Committee, Builder and the Architect. You and your committee members went on to
demoralise Mrs. Gurmeet Kaur Saini (a Woman Senior Citizen) by not hesitating to institute both Civil and Criminal proceedings for defaming the honorary committee members. Since you could not prove her contentions and charges incorrect, why civil and criminal proceedings not be
initiated by the society members against all you 7 members who are signatories to the said letter of yours for defaming Mrs. Gurmeet Kaur and landing the redevelopment project of our society in a big mess. I wonder how Mrs. Veena Thadani, a High Court Advocate who is supporting the cause of the dance bar girls for the upliftment of women of our country would react to defamation of a woman, Mrs. Gurmeet Kaur Saini, who is devotedly working for expediting the standstill
redevelopment project of our society in safeguarding her, and in framing the Managing Committee for their lingering attitude and tremendous delay beyond expections with the completion of only 2 towers in a period of 10 years and that too without OC along with various other non-complaince issues. However in the case of the redevelopment project of our society it appears that the same Mrs. Veena Thadani, who is also a member of the society and aided by her better half in supporting the irregularities and illegality of our society’s managing committee by giving an indirect protection to the MC members.

The Inside Story and the Truth Declaration of our Society’s Redevelopment Project with
M/s. Hiranandani Constructions Pvt. Ltd., Architect and the Managing Committee
in the 5 years of elected period.
During the formation of the new Managing Committee in the year 2011 there was a revolution in the
society of having a change in getting transparency in the redevelopment project as the said redevelopment agreement was null and void and irregularities committed regarding issues on 70000 sq.ft. balconies, violation of agreement and other relevant issues introduction of PMC which was the main manfesto of the redevelopment project. All youngsters elected above the age group of 45 lend theirselves for bringing better prospects and for timely completion of the project by standing together. And today the whole committee with other tainted members whom we proposed and had confidence in, turned turtle, let down the whole society to a disgusting position. The so called member, in particular, Mr. Suresh Arora, a new born baby in whom the members had good faith in his transparency and good administration, reversed over a period of time along with Mr. Bhagwan Thadani and other 5 members, in influencing the other close members and friends who were the cream of this project viz. Mr. Anand Rao, Mr. Naval Shinde, Mr. Sunil Shahani, Mr. Virendra Khanna, Mr. Hemraj Gandhi, by taking them into confidence and giving them undue benefits to their advantage, like transferring of shares in flats of likelyhoods, giving extra benefit in carpet areas, making non-related blood relationship a shareholder in the new tower flats, assistance for internal flat repairs at the time of external building repairs for selected individuals, flat transfers and granting benefits to them from members sinking fund, creating agents and brokers in the society for buying and selling of flats,
cheating andbenefitting by committee members on single tender basis in road and building repair works with royalties and commissions, etc. To kill time and to gain advantage of maximum benefits for the builder with the new DC Rules, the Managing Committee, through the said members
initiated a propaganda of going in for new greenfield project and 1:1 flat. All these members along with Mr. Bhagwan Thadani, Mrs. Veena Thadani, Mr. Suresh Arora and the other Managing Committee Members had their meetings in the banquet hall of Mrs. Jaya Damodaran,
a Managing Committee member (in Building No. 22) which was specially made for the redevelopment project. The main purpose of these meetings was probably to garner support of most of the members of multi-storied buildings for benefitting the builder with maximum profit, and substantially personal gains for themselves and making a position for their future vote bank and in the process giving a step-motherly treatment to residents of F building by not hearing their grievances.
Achievements & Character of Mr. Suresh Arora
During the campaigning of elections in the year 2011, Mr. Suresh Arora and Mr. Laxman Gurbaxani went to meet Mr. Harish Hinduja at Veena Wines in Chembur for obtaining signature against Mr. Bhagwan Thadani, to which he obliged, prior to elections against the balcony issue of 70,000 Sq. ft. which was walloped by M/s. Hiranandani Constructions Pvt. Ltd. by cheating the society members, is now speaking in favour of the same Mr. Bhagwan Thadani. And now it seems Mr. Suresh Arora has gone and sat on the lap of the present Hon. Secretary adding to the other group of 5 MC members.
Mr. Suresh Arora was also instrumental in evicting the Beauty / Massage / Objectionable Parlour which was to come up in Building No. F, Flat No. 2 and which was purchased by a new member. As the then managing committee headed by Mr. Katyal (Hon. Chairman) and Mr. Bhagwan Thadani
(Hon. Secretary) did not take any action some of the members of our society pulled down the steel gate of the said upcoming Beauty Parlour and deposited the same in the society premises near the well. It has now been brought to my knowledge, and perhaps most of the society members may be knowing that the said Mr. Suresh Arora sold out the gate (amount in thousands) and siphoned off the
money instead of crediting the same in the society’s account.
His other achievements at his earlier residence in M/s. RNA Park CHSL, Vasinaka, Chembur would be brought to light very shortly.
All this mess has come about only because the members of our society are not united in coming forward to voice their opinion on this delayed redevelopment project. It is high time the members rise up and confront the current situation with a strong voice. Mr. Bhagwan Thadani was given a second golden opportunity as a Hon. Secretary to use his good office in expediting the redevelopment project. But instead he chose to go in for his and his family’s personal gains of buying, selling and renting of properties within the society and indirectly giving an advantage to the builder. At this juncture it is the members who have to judge and reject the current managing committee members (group of 7) for their ineffectiveness in taking forward the redevelopment project. The ball is in the members court to analyse the contributions made by the selected group of the managing committee and their other ancillary supporters, as mentioned hereinabove, and to consider the future redevelopment process of our
society with the required builders.

Letter No. DyChE/BP/2103/ES dt. 13/05/2016 from BMC addressed to
Mr. Ranjit Singh Saini regarding Occupation Certificate for Tower A and B.

Ref. : Your letter dt. 22-03-2015 addressed to my wife, Mrs. Gurmeet Kaur Saini.

Dear Sir,

In reference to your above referred letter you had mentioned that she had made false and baseless
allegations without support of any evidence which constituted defamation of members of the Managing
Committee I wish to state as under -

The allegations are not false and baseless and they just do not need any evidence as elucidated
herebelow -

The services of the PMC which was appointed by the General Body was discontinued by the Managing Committee without the consent of the General body, perhaps all to the advantage for the Managing Committee and the Builder. From the time-to time reports of the PMC pin-pointing on the deficiences in the progress of the redevelopment, and subsequent discontinuance of their services, it is evident that both the Managing Committee and the Builder found the PMC to be a hinderance in their so-called “co-ordinated working” and hence got them removed from scene without the consent of the General Body. This is the only apt conclusion which one can draw for the removal of the PMC. 
Does this act of
the Managing Committee need any evidence?
The redevelopment project started in the year 2008 and both the two towers were completed
2011. It is now almost 5 years down the lane and there is still no sight of the Occupation
Certificate in respect of the completed buildings. When the Managing Committee had removed the
PMC then was it not the duty of the Managing Committee to follow up on the redevelopment progress from the point when the services of the PMC was terminated. Did the Managing Committee see the “wrong-doings” of M/s. HCPL comstruction progress whereby the builder constructed an additional 10 ft.of construction work over and above the sanctioned plan. Was it not the duty of the Managing Committee to intimate the builder about the wrong-doing and to take appropriate action against them? Does this act of the Managing Committee also require any evidence? What was the
Managing Committee doing since the last 5 years from the year 2011 till 29-04-2016 (date of
application for OC to Executive Engineer, Building Dept.as per their letter
No. DyChE/BP/2103/ES dt. 13/05/2016 addressed to Mr. Ranjit Singh Saini). A copy of the said
BMC’s reply in this respect is attached herewith for ready reference.

This shows that during the five years tenure of the Managing Committee, I and many other members of the society are of the opinion that during this period the Managing Committee, instead of looking into the  redevelopment progress, in the greater interest of the members at large, confined their main objectives into looking after their own personal interest and that of the builder which is quite evident as the Managing Committee has as of date not achieved anything material as the entire project is at a standstill since the last5 years without any progress whatsoever.

 You have also mentioned in your said letter dt. 22-03-2015 that “the Managing Committee reserves
its rights to initiate both Civil and Criminal proceedings against Mr. Gurmeet Kaur Saini for
defaming the honorary Managing Committee members of the Society”. In fact wouldn’t it be
correct if the members of our society initiate both Civil and Criminal proceedings against the
Managing Committee members, viz. Mr. B.C. Thadani, Mr. M.H. Nayak, Mr. Suresh Arora,
Mr. Kishore Vengsarkar, M. Vinod Thadani, Mrs. Jaya Damodaran and Mr. Sanjay Lodha, who
are part and parcel of having signed the Managing Committee’s letter dt. 23-03-2015 for -
1) Misleading the members of the society time and again by presenting incorrect facts of
the redevelopment progress underway.
2) Removal of the PMC without the concurrence of the General Body, like I had said
earlier, perhaps for their own, and personal interests of the builder.
3) Not looking into the irregularities commited by the builder (in the absence of the PMC)
which is now causing a hinderance in our getting the Occupation Certificate (now applied
on 29-04-2016 ... after a period of 5 years).
4) Not terminating the redevelopment agreement as the builder failed to get the OC within
a period of three months from the date of the General Body as per the resolution passed
thereat.

IT HAS ALSO COME TO MY KNOWLEDGE THAT SINCE THE LAST 4 YEARS THE
BUILDER / ARCHITECT / MANAGING COMMITTEE DID NOT EVEN APPLY TO THE
BMC FOR OCCUPATION CERTIFICATE, WITH ALL COMPLIANCES IN PLACE. HOW
THEN DOES ONE EXPECT THE OC FROM THE BMC IN ABSENCE OF ANY
APPLICATION FOR THE SAME. THE MANAGING COMMITTEE HAS ALL THE TIME
BEEN MAKING LAME EXCUSES VIZ. THAT TWO OF THE MC MEMBERS ALONG WITH
TWO OTHER MEMBERS ARE CAUSING HINDERANCE IN OBTAINING THE OC. THE
MANAGING COMMITTEE HAS ALL THE TIME KEPT THE MEMBERS IN DARK. THE
EFFICIENCY OF THE MANAGING COMMITTEE IS JUST ZERO. AT THIS JUNCTURE
IT WOULD BE APT FOR THE MC MEMBERS TO HANG THEIR HEADS IN SHAME
AND TO SUBMIT THEIR RESIGNATIONS FORTHWITH.

In fact I would like to enlighten on the fact that my wife, Mrs. Gurmeet Kaur Saini had replied to your said letter dt. 22-03-2015 along with copies of evidences for all the violations of the
redevelopment agreement point to point, to which the Managing Committee did not revert back.
Inspite of such fallacies commited by the Managing Committee, the members were allegated for causing hinderances in the redevelopment work and in the last 10 years the situation has gone from bad to worse in relation to the redevelopment process. It would therefore be wise if all the members of the Managing Committee as referred to hereinabove pen down their resignation with immediate effect and oblige the members of our society, because even as of date I have doubts whether we will get the Occupation Certificate with all the required compliances?

Respected Sir,

This has reference to the above referred subject whereby I, as a bonafide member of the society require certain informations and explanations for the unwarranted delay tactics in completion of the said redevelopment work as of date. The facts of the case as you may be aware are elucidated as here below
-
1) The redevelopment project of our society commenced in the year 2006 and was suppossed to be
completed in a period of 7 years time in 2013. However as of date, 10 years down, only two
towers have been constructed that too incomeplete in some respects and still without Occupation
Certificate from the BMC. The PMC which was appointed by the General Body to look
into the progress of the redevelopment process and which was subsequently removed from the
said project without concurrence of the General Body. It is evident that the Managing Committee,
the Builder along with the Architect (yourself) found the PMC to be a hinderance in your
so-called “co-ordinated working” and hence got them removed from scene without the
consent of the General Body. I am also of the knowledge that the consent from the Civil
Aviation Authorities was not obtained which should have been done before the commencement of
the project. And also the subsequent clearance of satisfactory compliance on successful
completion of the said two towers has not yet been obtained which is prior requisite for
obtaining the Occupation Certificate (OC) in respect of the said two constructed towers. The
reasons being that an extra 10 ft. of contruction over and above the sanctioned height
was constructed by the builder which I believe has been subsequently rectified and a fresh
application has been made to the relevant authorities for obtaining the OC. Subsequent to the
removal of the PMC, was it not your duty to look into this irregularity and report to the Managing
Committee?

2) There are also many instances of incorrectness in measurements of the constructed elevation heights
and the carpet area actually available and that as per the plan for individual flats in each floor, in the
two towers so constructed. Your silence in the matter shows your connivance with the
builder and the Managing Committee in the irregularities committed.

3) From the copy of the BMC’s reply to my letter, available to me I am able to understand that a fresh
application has been made by you on I am informed that the Part Occupation Certificate was
issued on 18-02-2013 for 39 No. of flats and on 24-02-2014 for one flat for rehab of existing
members after the approval of Ch.E.(D.P.) / Hon’ble M.C. subject to compliance of balance IOD
conditions before full occupation. Thereafter till date the progress is at a standstill for reasons best
known to the Managing Committee and the Builder and Architect.

4) The BMC also informed that the Airport Authority of India has objected to the height of the
building vide their letter dt. 28-08-2004 and 03-09-2015. The BMC further state that the
Architect was informed about the same vide their office letter dt. 05-12-2014, 07-01-2015 &
22-04-2015respectively directing to remove the construction work carried out beyond
permissible height of Civil Aviation or to submit revised Civil Aviation N.O.C. for the constructed
height. They further added that the request for Occupation Certificate would be considered on
compliance of the above and balance IOD conditions.

5) Meanwhile the BMC received complaints regarding erection of framework for placing of water
tanks. The same was informed to Asst. Engr. (B&F) M/W Ward thereafter which Stop Work
Notice was issued by the Asst. Engr. (B&F) M/W Ward to the owner / C.A. to owner and
developer. The BMC letter further says that the Architect on 15-06-2015 had submitted amended
plans for reducing height of the existing R.C.C. water tank and installation of P.V.C. water tanks.
The amended plans were submitted on 05-01-2016 and that the Architect has applied for
Commencement Certificate on 11-04-2016. The C.C. was issued on 22-04-2016 for the said
amended plans.

6) The BMC department has now confirmed that the part O.C.C. application has been forwarded
by the Architect on 29-04-2016 for A & B Towers except podium floor, further stating that the
same will be processed on compliance of balance IOD conditions and O.C.C. will be issued on its
merits and compliance of the same.
My question to you is that was not your duty in particular along with the Managing Committee, in the
absence of any PMC, to keep check on the illegal regularities in constructions so carried out by the builder because of which our entire redevelopment work has sufferred thereby causing a lot of inconvenience to all the members of our society because of the inordinate delay which was uncalled for. The exhorbitant delay is beyond expectation!
Misleading the members of the Managing Committee by presenting incorrect fact of the
irregularities in the progess underway during construction / execution.
Not looking into the irregularities committed by the builder and not taking action for
stopping work. What was the need for the BMC for taking action to stop work at a later
date?

I sincerely hope that you would be kind enough to reply to this letter of mine within 7 days, else I would be compelled to approach the Council of Architects, Mumbai for necessary action which perhaps could result in blemishing your image and revocation of your licence to practice at this juncture of your professional carreer, which you may please note.

In my opinion even today I presume that the Occupation Certificate will not be in compliance with the conditional requirements. Kindly let me know when the compliance from your end for obtaining the Ready-to-occupy Occupation Certificate for the effected members.
