Sinking Fund Misuse

~ Misappropriation/Misapplication of the funds of the society

Without taking approval of society members of building and flats. No estimation and budgets have been provided neither approved from the society members and the deductions have  been made directly from accounts without finalizing the amount and have directly remitted

to their accounts and credited to the contractors who have executed the contracts for the various buildings and flats by the Managing Committee.

~ Road Repair (Contract worth Rs. 3.25.000 approximate)

Without knowledge of general body no approval has been taken and no resolution has been passed for granting of funds for any of the above utilizations of funds.

The road repair contracts during the tenure of Mr. Bhagwan Thadani as secretary from 05/05/2013, he along with his committee members has totally misused the funds of the society as the society treasury seems to be belonging to the committee members ,has totally misused and diluted the funds and emptied out the members funds deposit by the members

for the last 40 to 45 years and THEIR HARD EARNED MONEY HAS BEEN WASHED OUT.

~ Tree Cutting~ of society surrounding~

Without the approval the seven committee members in place of nine had contracted tree cutting for an amount of Rs.2,30,000 approximate which as per my knowledge should not exceed more than above Rs. 80,000 +- 10 % over and above. The contract amount has exceeded the normal expenses for the said work.

~ The sinking~ fund and other repair & Maintenance Funds has been totally misused the part amount is been siphon by the committee for the reasons best known to them.

• Investment of funds without prior permission of general body meeting held on November 2011 resolution passed for transferring of funds form Punjab & Maharashtra Co-Op Bank to any other Bank due to security risk on maturity as this leads to breaking of general rules of ~ '

the general body meeting, approximate Rs. 4, 44, 49,062(Rupees Four Crores Forty Four Lakhs Forty Nine Thousands and Sixty Two Only) as per letter dated 08/07/2016 to

Ref. : Undated Circular issued by persons for harassing the members demand for meeting
with office bearers and the Managing Committee members under the provisions of the
MCS Act, 1960.

72 members on 04-04-2013, 80 members letter dt. 30-07-2013, 27 members
letter dt. 08-07-2016 and 107 members letter dt. 08-05-2016 respectively addressed to
the Registrar & Dy. Registrar of Co-operative Societies.

Dear Respected Sir,
This is in respect to the undated letter circulated to members by the 7 known Committee Members who are in the Managing Committee viz. Mr. M.H. Nayak, Mr. Kishor Vengsarkar,
Mr. B.C. Thadani, Mr. Suresh Arora, Mr. Sanjay Lodha, Mr. Vinod Thadani & Mrs. Jaya
Damodaran and the excluded isolated, debarred and objectional Managing Committee members, Mr. Laxman Gurbaxani & Mr. Anil Kapur who are not in the panel for the reasons best known to them.

The Managing Committee election to be held is as per the requirement of the Society bye-laws.
Now it is to draw your attention to show that you have from the time you have accepted the responsibility of Hon. Secretary of our society, Mr. Bhagwan Thadani, you have played your trump card and shown your true colours along with you and your other 6 committee members.

Your 2 letters are unjustified by the Hon. Chairman from members as per Mr. Anil Kapur letter
dt. 04-04-2013 for isolating Mr. Anil Kapur from active participation in the redevelopment process supported by 72 signatories. The other letter dt. 30-07-2013 to the Hon. Secretary and the Hon. Chairman towards allotment of additional flat No. 502-B to Mr. Bhagwan Assanmal Rajasth in lieu of existing Flat No. C-3/2 to Mrs. Komal S. Shahani & Mr. Sunil G. Shahani supported by 80 signatories. The acts of Hon. Secretary are detrimental to the interests of non-proper working of  the society as per the society bye laws and misleading the Registrar for the above act. You and your managing committee members have misrepresented the society members by giving false presentation of resolution in GBM & MC meetings held on various occassions since 2013-14-15 without taking the consent and approval of the Dy. Registrar on various occassions and you, the secretary deem fit to work as per his direction and decided by himself and have also overuled the Maharashtra Co-operative Act 1960 & Rules 1961 of the Society’s Adoption of new bye laws.
Regarding inspection of documents by myself, I was called for the inspection of documents as
requested as per provisoons of section 32 of the Maharashtra Co-operative Societies Act, 1960.
1) Your letter dt 16-07-2016 for inspection on 18-07-2016. My letter dt. 18-07-2016 towards
application for extention to any further suitable date.
2) Your letter dt. 18-07-2016 and further my letter dt. 18-07-2016 for inspection of
documents on 21-07-2016.
3) Through my letter dt. 21-07-2016 I have requested to extend the appointment for around
12 days as I was attending to legal consultants for society matter in the general interest of
the members at large. Thereafter I did not received any reply from your end.
Your contention for harassing the employees of the society and abusing and forcing them to leave the services is totally false and frivolous allgation you are hereby requested to put to stick proof from the office bearers with written commitment. The Hon. Secretary is mis-guiding and
mis-informing the society members for his personal credit and gain.
Since as an administrative requirement and gesture to interact with the office staff we had called
upon for clarification of society activities and as you did not respond we the senior citizen members had the privilege to conduct the meeting to amicably solve the solution. But you never took the initiative to call a courtesy meeting for the members to interact and you to secure yourself under the society bye-laws guidance which you tried to show your incapability on the above matter.
Your contention about O.C. is just that you are trying to hide under the mischevous acts and with
wrong practice and not expediting along with the Architect and the Builder. This is only a gimmick shown to the members of the society without taking any interest or effort to solve and bring the O.C. to the members who are still waiting to enter the new premises on receiving of same from 2013 till date. All of you 7 members are syndicating and co-operating with the Architect and the Developer hand in hand for a long duration affecting from 18-02-2013 for 39 nos. of flats on 24-02-2014 for
1 flat for rehabilitating of existing member after the approval of ChE(DP) Hon’ble M.C. subject to compliance of balance IOD condition before full occupation as per letter no. Dh/Che/BP 2013
dt. 13-05-2016.
Your contents for calling a SGB wheras we members had called for a preliminary meeting,
discussion raised by some of the known members with other members to join in, who are very much interested for the success of the redevelopment, the Managing Committee should have seen the wider perspective and not bring in procedures of law into this subject and try to keep the bye-laws aside in the welfare interest of the members for considering the justification of the members who have come forward with grievances and better prospects and timely completion of the redevelopment project.
I hope on behalf of the members of the society the Managing Committee of 7 known selcted
members for redevelopment will understand the impact of the members and try to come out of the situation and behave in an unified manner and not have the ratio of 7 versus 2 members in which this shows that we the members have lost confidence and loss of faith in you members. Your management and administration has been shatterred with no powerful results. You have failed technically and you are not sound for the position to handle the society’s affairs and
administration. It seems to be a total disaster of what have been concluded in the last 10 years of unsatisfactory performance.
Please do not under estimate the power of a common man for natural justice and common cause of the 267 members who have been patiently waiting for the better prosperity of the society’s
redevelopment and trying to accelerate for oriental results for all the members of the buildings and flats including the most affected senior citizens staying in the houses since the last
45 years. I have taken up the cause and am working in the interest of the members of our society for their future betterment and am not against redevelopment. The other relevant issues of personal nature are not having any importance for giving any opinion because the Hon. Secretary, Mr. Bhagwan Thadani in his earlier tenure has forcibly made the earlier committee to pass resolution to his advantage for turning residential premises into commercial and turning it into a hospital for his son, Dr. Amit Thadani and creating a nuisance in the society for the fellow members. Almost all the ground floor members have encompassed various portions of the land area with beautification and landscaping as per their choice around their flats as per their privilege and all the said members have given an undertaking to give up the same in lieu of new flats in the redevelopment project. So please do not drag these issues and convert the good minds of our society members into a criminal one. Your co-operation and good deeds and future followup is awaited very patiently by our society members in the right direction.
All the best of luck to all the new young Managing Committee members in the age group of
20-40 years who will be taking over the reins of the future redevelopment for better
achievement and prosperity and aspiration and the dreams of the senior citizens who are
residing in buildings and bungalows.
Before I conclude and write this last letter on the redevelopment issue, if you feel that anything told by me or any hard feelings to any one, I regret for the same for that was not my true intention. In spite of my several letters you feel that the present committee members are indulging in the right track for the redevelopment and on receiving correspondence from the managing committee, your justice and judgement has to be decided by you and you alone. You are the best judge. The ball is now in your court. But a bit of caution ... beware of unsatisfactory elements whom you have judged for the past 5 years in committee members and other members.
I therefore request your good self to kindly look into the copies of the letters of objections by the members on various issues as enclosed herewith for your kind perusal and ready
reference.

Sincerely yours,
RANJIT SINGH SAINI

Developer - M/s. Hiranandani Constructions Pvt. Ltd.;
Architect - Mr. Bansi H. Wadhwa, Architect.

Dear Sir,

At the outset we thank you for your kind co-operation extended to Mr. Ranjit Singh Saini, a Member and Senior Citizen of our Society and giving him a patient hearing on 05-07-2016. During his brief discussion with your good self he had appraised you about the functioning of the Managing Committee of our Society with only 7 active members out of 9 who regularly sign various official communication to members barring the 2 isolated members, viz. Mr. Anil Kapur and Mr. Laxman Gurbaxani without informing or assigning any reasons whatsoever to the members, which has come to our knowledge recently. This understanding has been inferred from such instances some of which are as follows -

1) The letter dt. 17-03-2015 from one of the society members, Mrs. Gurmeet Kaur Saini was
replied vide the Society’s letter dt.22-03-2015 which carried 7 Managing Committee members
signatures out of 9 isolating 2 members without the approval of the Managing Committee
members and in absence of proper meeting and resolution in which the Managing Committee
threatened her by resorting to institute legal and criminal proceedings when she enquired regarding
violations in the redevelopment project and general affairs of the society which was replied by her
with documentary evidence pointwise vide letter dt. 06-04-2015. Since the last 18 months the
Managing Committee failed to respond to the above letter. [Exhibit-A]

2) The Managing Committee of 7 members informed all the society members vide letter which was
undated and unsigned by the Managing Committee which speaks of increasing the corpus from
Rs. 30.0 crores to Rs. 100.0 crores in view of the current market conditions.[Exhibit-B]

3) Inspite of directions from the Dy. Registrar of Co-op. Societies, M-Ward, the Managing
Committee members failed to furnish copies of various documents for the period from Jun-2006
to May 2016 relating to the society’s redevelopment project, 3 years Balance Sheets for the years
2012-13, 2013-14 & 2014-15 resp. pursuant to the letters by one of the society’s member,
Mr. Ranjit Singh Saini. The Managing Committee consistently gave unnecessary lame excuses for
not furnishing the required documents (letter No. RSS/2016-17 dt. 27-05-2016). The same is not
received till today inspited repeated reminders from the Dy. Registrar under the RTI Act. ( Letter
Members of Maitri Park CHSL.

HAND DELIVERY
No. 613/616 both dt. 26-05-2016 and No. 816 dt. 05-07-2016 and Mr. Ranjit Singh Saini’s
letter dt. 27-05-2016. All these letters have been ignored for the reasons best known to the
Managing Committee. [Exhibit-C]

4) Inspite of letters by the members to the Managing Committee for isolation and ignoring one of
the 2 isolated members (letter dt. 04-04-2013) signed by 72 members, instructing the
Managing Committee to take proper advice and utilise the services of the aforesaid member in
the interest of the society members in the redevelopment project, regarding the objectionable
points related to the redevelopment, since the said member is well experienced and had
knowledge about the redevelopment procedure, the same was completely ignored by the
Managing Committee. [Exhibit-D]

5) In a reply to the query of one of our society’s respected member, Mr. I.M. Saxena
residing in Flat No. C-12/4, asking for a copy of the legal notice sent to the Developer by the
Managing Committee, the Managing Committee falsely replied to him by furnishing a copy
of the General Body resolution instead of the Legal Termination Notice which ought to
have been sent after which was never sent in spite of the General Body resolution, and
went further still claiming that they had served the Legal Notice of Termination to the
representative of Developer, Mr. Gurnani on 29-09-2014 as claimed by the Hon. Secretary vide
his letter dt. 26-02-2015 to have been circulated to the members. However even after
15-10-2014 till date the Developer has not obtained the Occupation Certificate, and which he
failed to do so, the said Legal Notice for Termination of his contract was not forwarded to
them since the legal notice for termination was not sent by the Managing Committee. [Exhibit-E]

6) We understand that the society has Fixed Deposits in the Punjab & Maharashtra Co-operative
Bank Ltd., Chembur Branch aggregating to Rs. 4,44,49,072/- (Rupees Four Crores Forty-four
Lakhs Forty-nine Thousand Seventy-two only). At the Annual General Body Meeting of our
society held in November, 2011 at the Maitri Park Garden objections were raised followed by
discussion and debate regarding having Fixed Deposits in the Punjab & Maharashtra Co-op.
Bank Ltd. wherein a resolution proposed by Mr. Sunil Shahani & seconded by Mr. Krishinlal
Katyal was passed to transfer the various Fixed Deposits from the Punjab & Maharashtra
Co-operative Bank Ltd. to any other Bank pursuant to their maturity as and when since almost all
members had lost confidence in the Punjab & Maharashtra Co-op. Bank, Chembur Branch due
to the bad reputation during the prevailing period as such a huge amount was at stake. However
we find that our society still contnues to have Fixed Deposits in the said bank as of date which
amounts to violation of General Body resolution. Exhibit-F]

7) The various letters addressed to the Managing Committee have never been replied to
till today viz. letters dt. 03-03-2015, 16-03-2015, 09-06-2015, 19-03-2016, 06-04-2016,
01-06-2016, 02-06-2016, 09-06-2016, 20-06-2016, 22-06-2016, 01-07-2016, 04-07-2016
and 05-07-2016 respectively. The most active committee members ruling the Managing
Committee viz. The Hon. Secretary, Mr. Bhagwan Thadani and the Hon. Chairman,
Mr. M.H. Nayak have not taken initiative in replying and responding to the said letters. This
clearly proves that the abovementioned persons have vested interests and are not working in the
interest of the society.
Members of Maitri Park CHSL.

8) The Managing Committee allowed some members to shift on part O.C. (for demolished buildings
No. 1-5) and with furniture possession for Bldg. Nos. 35 to 38. Some of the members who had
occupied the allotted flats in the 2 Towers ‘A’ & ‘B’ had received eviction notices from the BMC
as per inspection report dt. 08-08-2014 (MCGB letter No. CE/6273/BPES/AM
dt. 08-08-2014). The penalty for the same was paid by the Developer on behalf of the resident
members. As such few members have not shifted to the new flats were hesitant and were citing
such cases for non-shifting due to non-availability of occupation certificate which is illegal.
[Exhibit-G]

9) The Developer in connivance with the Managing Committee and the Architect have committed
gross violations and irregularities in the said redevelopment project for which criminal case has
been lodged by one of the aggrieved members. The Managing Committee members are currently
on bail. The project has been inordinately delayed and stalled and all the 267 members of the
society are affected by the said acts of the Managing Committee, Developer and the Architect.
A copy of the F.I.R. in respect of the said Managing Committee members viz. Mr. M.H. Nayak,
Mr. Bhagwan Thadani, Mr. Kishor Vengsarkar, Mrs. Jaya Damodaran, Mr. Suresh Arora,
Mr. Sanjay Lodha, Mr. Anil Kapur, Mr. Laxman Gurbaxani and Mr. Vinod Thadani, Mr. Niranjan
Hiranandani of M/s. HCPL. (Developer) and Mr. Bansi M. Wadhwa (Architect) is enclosed
herewith for your kind perusal. [Exhibit-H]

In view of the aforesaid facts and circumstances, we the undersigned make humbly request you to use yourgood office by taking appropriate action as per rules / law against the Managing Committee members and save our 267 members, majotity of whom are Senior Citizens.

Thanking you in anticipation of your kind consideration. An early action in this matter will be highly
appreciated.

The Hon. Secretary,

Sub. : Redevelopment Project of Maitri Park CHSL.
Ref. : Your letter dt. 22-03-2015;
Letter dt. 17-03-2015 .
Letter dt. 06-04-2015 .
Dear Sir,
This letter of mine has specfic reference to your above referred letter dt. 22-03-2015 which was replied to point to point vide my letter dt. 06-05-2015 which was substantiated by documentary evidences disapproving your explanations, contentions and allegations in your said letter of my wife trying to defame the Managing Committee members. You have failed to reply to her said letter which goes to prove that the documentary evidences furnished (Attachments 1 to 10) by her only confirmed the contentions of the letter dt. 17-03-2015 to be true. I am still awaiting your reply to my
said letter dt. 06-05-2015 and am looking forwards to the denial of your managing committees wrong-doings. Your silence on the said letter would only amount to you and your managing committee accepting your defaults on the redevelopment project by having cheated the society
members for their own personal gains.
You may be informed that my wife, the only woman with no backing of any member had singularly
stood for the society members against the irregularities and agreement violation in our redevelopment project. And she was from time to time informing the managing committee and
the members at large about the irregularities being committed in our redevelopment project.
Your letter dt. 22-03-2015 carries only 7 signatures of the Mananging Committee members
instead of 9 members, viz. Mr. B.C. Thadani, Mr. M.H. Nayak, Mr. Suresh Arora, Mr. Kishore Vengsarkar, Mr. Vinod Thadani, Mrs. Jaya Damodaran and Mr. Sanjay Lodha. Kindly enlighten me as to why the other two members viz. Mr. Anil Kapur and Mr. Laxman Gurbaxani who seem to
be isolated from your golden group not sign your said letter along with the other MC members? Was it because they were not invited to this so called meeting or is it that they refused to sign the letter which contained invalid and irrelevant explanations to shelter the wrong-doings of the consortium of the Managing Committee, Builder and the Architect. You and your committee members went on to
demoralise Mrs. Gurmeet Kaur Saini (a Woman Senior Citizen) by not hesitating to institute both Civil and Criminal proceedings for defaming the honorary committee members. Since you could not prove her contentions and charges incorrect, why civil and criminal proceedings not be
initiated by the society members against all you 7 members who are signatories to the said letter of yours for defaming Mrs. Gurmeet Kaur and landing the redevelopment project of our society in a big mess. I wonder how Mrs. Veena Thadani, a High Court Advocate who is supporting the cause of the dance bar girls for the upliftment of women of our country would react to defamation of a woman, Mrs. Gurmeet Kaur Saini, who is devotedly working for expediting the standstill
redevelopment project of our society in safeguarding her, and in framing the Managing Committee for their lingering attitude and tremendous delay beyond expections with the completion of only 2 towers in a period of 10 years and that too without OC along with various other non-complaince issues. However in the case of the redevelopment project of our society it appears that the same Mrs. Veena Thadani, who is also a member of the society and aided by her better half in supporting the irregularities and illegality of our society’s managing committee by giving an indirect protection to the MC members.
Sincerely yours,

MAITRI BACHAAO .. REDEVELOPMENT KO AAGE LAAO
OC ... OC ... OC ...
The Inside Story and the Truth Declaration of our Society’s Redevelopment Project with
M/s. Hiranandani Constructions Pvt. Ltd., Architect and the Managing Committee
in the 5 years of elected period.
During the formation of the new Managing Committee in the year 2011 there was a revolution in the
society of having a change in getting transparency in the redevelopment project as the said redevelopment agreement was null and void and irregularities committed regarding issues on 70000 sq.ft. balconies, violation of agreement and other relevant issues introduction of PMC which was the main manfesto of the redevelopment project. All youngsters elected above the age group of 45 lend theirselves for bringing better prospects and for timely completion of the project by standing together. And today the whole committee with other tainted members whom we proposed and had confidence in, turned turtle, let down the whole society to a disgusting position. The so called member, in particular, Mr. Suresh Arora, a new born baby in whom the members had good faith in his transparency and good administration, reversed over a period of time along with Mr. Bhagwan Thadani and other 5 members, in influencing the other close members and friends who were the cream of this project viz. Mr. Anand Rao, Mr. Naval Shinde, Mr. Sunil Shahani, Mr. Virendra Khanna, Mr. Hemraj Gandhi, by taking them into confidence and giving them undue benefits to their advantage, like transferring of shares in flats of likelyhoods, giving extra benefit in carpet areas, making non-related blood relationship a shareholder in the new tower flats, assistance for internal flat repairs at the time of external building repairs for selected individuals, flat transfers and granting benefits to them from members sinking fund, creating agents and brokers in the society for buying and selling of flats,
cheating andbenefitting by committee members on single tender basis in road and building repair works with royalties and commissions, etc. To kill time and to gain advantage of maximum benefits for the builder with the new DC Rules, the Managing Committee, through the said members
initiated a propaganda of going in for new greenfield project and 1:1 flat. All these members along with Mr. Bhagwan Thadani, Mrs. Veena Thadani, Mr. Suresh Arora and the other Managing Committee Members had their meetings in the banquet hall of Mrs. Jaya Damodaran,
a Managing Committee member (in Building No. 22) which was specially made for the redevelopment project. The main purpose of these meetings was probably to garner support of most of the members of multi-storied buildings for benefitting the builder with maximum profit, and substantially personal gains for themselves and making a position for their future vote bank and in the process giving a step-motherly treatment to residents of F building by not hearing their grievances.
Achievements & Character of Mr. Suresh Arora
During the campaigning of elections in the year 2011, Mr. Suresh Arora and Mr. Laxman Gurbaxani went to meet Mr. Harish Hinduja at Veena Wines in Chembur for obtaining signature against Mr. Bhagwan Thadani, to which he obliged, prior to elections against the balcony issue of 70,000 Sq. ft. which was walloped by M/s. Hiranandani Constructions Pvt. Ltd. by cheating the society members, is now speaking in favour of the same Mr. Bhagwan Thadani. And now it seems Mr. Suresh Arora has gone and sat on the lap of the present Hon. Secretary adding to the other group of 5 MC members.
Mr. Suresh Arora was also instrumental in evicting the Beauty / Massage / Objectionable Parlour which was to come up in Building No. F, Flat No. 2 and which was purchased by a new member. As the then managing committee headed by Mr. Katyal (Hon. Chairman) and Mr. Bhagwan Thadani
(Hon. Secretary) did not take any action some of the members of our society pulled down the steel gate of the said upcoming Beauty Parlour and deposited the same in the society premises near the well. It has now been brought to my knowledge, and perhaps most of the society members may be knowing that the said Mr. Suresh Arora sold out the gate (amount in thousands) and siphoned off the
money instead of crediting the same in the society’s account.
His other achievements at his earlier residence in M/s. RNA Park CHSL, Vasinaka, Chembur would be brought to light very shortly.
All this mess has come about only because the members of our society are not united in coming forward to voice their opinion on this delayed redevelopment project. It is high time the members rise up and confront the current situation with a strong voice. Mr. Bhagwan Thadani was given a second golden opportunity as a Hon. Secretary to use his good office in expediting the redevelopment project. But instead he chose to go in for his and his family’s personal gains of buying, selling and renting of properties within the society and indirectly giving an advantage to the builder. At this juncture it is the members who have to judge and reject the current managing committee members (group of 7) for their ineffectiveness in taking forward the redevelopment project. The ball is in the members court to analyse the contributions made by the selected group of the managing committee and their other ancillary supporters, as mentioned hereinabove, and to consider the future redevelopment process of our
society with the required builders.
