with
office bearers and the Managing Committee members under the provisions of the
MCS
Act, 1960.

members on 04-04-2013, 80 members letter dt. 30-07-2013, 27 members
letter
dt. 08-07-2016 and 107 members letter dt. 08-05-2016 respectively addressed to
the
Registrar & Dy. Registrar of Co-operative Societies.
Dear Respected Sir,
This is in respect
to the undated letter circulated to members by the 7 known Committee Members who
are in the Managing Committee viz. Mr. M.H. Nayak, Mr. Kishor Vengsarkar,
Mr.
B.C. Thadani, Mr. Suresh Arora, Mr. Sanjay Lodha, Mr. Vinod Thadani & Mrs.
Jaya
Damodaran
and the excluded isolated, debarred and objectional Managing
Committee members, Mr. Laxman Gurbaxani & Mr. Anil Kapur who are not
in the panel for the reasons best known to them.
The Managing
Committee election to be held is as per the requirement of the Society
bye-laws.
Now it is to draw
your attention to show that you have from the time you have accepted the
responsibility of Hon. Secretary of our society, Mr. Bhagwan Thadani, you
have played your trump card and shown your true colours along with you
and your other 6 committee members.
Your 2 letters are
unjustified by the Hon. Chairman from members as per Mr. Anil Kapur letter
dt. 04-04-2013 for
isolating Mr. Anil Kapur from active participation in the redevelopment process
supported by 72 signatories. The other letter dt. 30-07-2013 to the Hon.
Secretary and the Hon. Chairman towards allotment of additional flat No. 502-B to
Mr. Bhagwan Assanmal Rajasth in lieu of existing Flat No. C-3/2 to Mrs. Komal
S. Shahani & Mr. Sunil G. Shahani supported by 80 signatories. The acts of
Hon. Secretary are detrimental to the interests of non-proper working of the society as per the society bye laws and
misleading the Registrar for the above act. You and your managing committee
members have misrepresented the society members by giving false presentation of
resolution in GBM & MC meetings held on various occassions since 2013-14-15
without taking the consent and approval of the Dy. Registrar on various
occassions and you, the secretary deem fit to work as per his direction and
decided by himself and have also overuled the Maharashtra Co-operative Act 1960
& Rules 1961 of the Society’s Adoption of new bye laws.
Regarding
inspection of documents by myself, I was called for the inspection of documents
as
requested as per
provisoons of section 32 of the Maharashtra Co-operative Societies Act, 1960.
1) Your letter dt
16-07-2016 for inspection on 18-07-2016. My letter dt. 18-07-2016 towards
application for
extention to any further suitable date.
2) Your letter dt.
18-07-2016 and further my letter dt. 18-07-2016 for inspection of
documents on
21-07-2016.
3) Through my
letter dt. 21-07-2016 I have requested to extend the appointment for around
12 days as I was
attending to legal consultants for society matter in the general interest of
the members at
large. Thereafter I did not received any reply from your end.
Your contention for
harassing the employees of the society and abusing and forcing them to leave the
services is totally false and frivolous allgation you are hereby requested to
put to stick proof from the office bearers with written commitment. The Hon.
Secretary is mis-guiding and
mis-informing the
society members for his personal credit and gain.
Since as an administrative
requirement and gesture to interact with the office staff we had called
upon for
clarification of society activities and as you did not respond we the senior
citizen members had the privilege to conduct the meeting to amicably solve the
solution. But you never took the initiative to call a courtesy meeting for the
members to interact and you to secure yourself under the society bye-laws
guidance which you tried to show your incapability on the above matter.
Your contention
about O.C. is just that you are trying to hide under the mischevous acts and
with
wrong practice and
not expediting along with the Architect and the Builder. This is only a gimmick
shown to the members of the society without taking any interest or effort to
solve and bring the O.C. to the members who are still waiting to enter the new
premises on receiving of same from 2013 till date. All of you 7 members are
syndicating and co-operating with the Architect and the Developer hand in hand
for a long duration affecting from 18-02-2013 for 39 nos. of flats on
24-02-2014 for
1 flat for
rehabilitating of existing member after the approval of ChE(DP) Hon’ble M.C.
subject to compliance of balance IOD condition before full occupation as per
letter no. Dh/Che/BP 2013
dt. 13-05-2016.
Your contents for
calling a SGB wheras we members had called for a preliminary meeting,
discussion raised
by some of the known members with other members to join in, who are very much interested
for the success of the redevelopment, the Managing Committee should have
seen the wider perspective and not bring in procedures of law into this
subject and try to keep the bye-laws aside in the welfare interest
of the members for considering the justification of the members who have come
forward with grievances and better prospects and timely completion of the
redevelopment project.
I hope on behalf of
the members of the society the Managing Committee of 7 known selcted
members
for redevelopment will understand the impact of the members and try to come out of
the situation and behave in an unified manner and not have the ratio of 7
versus 2 members in which this shows that we the members have lost
confidence and loss of faith in you members. Your management and
administration has been shatterred with no powerful results. You have failed
technically and you are not sound for the position to handle the society’s
affairs and
administration.
It seems to be a total disaster of what have been concluded in the last 10
years of unsatisfactory performance.
Please do not under
estimate the power of a common man for natural justice and common cause of the
267 members who have been patiently waiting for the better prosperity of the
society’s
redevelopment and
trying to accelerate for oriental results for all the members of the buildings
and flats including the most affected senior citizens staying in the houses
since the last
45 years. I have
taken up the cause and am working in the interest of the members of our society
for their future betterment and am not against redevelopment. The other
relevant issues of personal nature are not having any importance for giving any
opinion because the Hon. Secretary, Mr. Bhagwan Thadani in his earlier tenure
has forcibly made the earlier committee to pass resolution to his advantage for
turning residential premises into commercial and turning it into a hospital for
his son, Dr. Amit Thadani and creating a nuisance in the society for the
fellow members. Almost all the ground floor members have encompassed
various portions of the land area with beautification and landscaping as per
their choice around their flats as per their privilege and all the said members
have given an undertaking to give up the same in lieu of new flats in the
redevelopment project. So please do not drag these issues and convert the
good minds of our society members into a criminal one. Your
co-operation and good deeds and future followup is awaited very patiently by our
society members in the right direction.
All
the best of luck to all the new young Managing Committee members in the age
group of
20-40
years who will be taking over the reins of the future redevelopment for better
achievement
and prosperity and aspiration and the dreams of the senior citizens who are
residing
in buildings and bungalows.
Before I conclude
and write this last letter on the redevelopment issue, if you feel that
anything told by me or any hard feelings to any one, I regret for the same for
that was not my true intention. In spite of my several letters you
feel that the present committee members are indulging in the right track
for the redevelopment and on receiving correspondence from the managing committee,
your justice and judgement has to be decided by you and you alone. You are the
best judge. The ball is now in your court. But a bit of caution ... beware
of unsatisfactory elements whom you have judged for the past 5 years in
committee members and other members.

therefore request your good self to kindly look into the copies of the letters
of objections by the members on various issues as enclosed herewith for your
kind perusal and ready
reference.
